Understanding No-Fault Divorces in Abu Dhabi Civil Court

What Is a No-Fault Divorce?

A no-fault divorce allows either spouse to unilaterally end the marriage without proving wrongdoing, such as adultery, separation or abuse. The court does not require evidence of fault or consent from the other party. This marks a departure from traditional Shariah based proceedings and is more aligned with Western legal systems.

The Divorce Process

  • Filing the application
    Either party may file a divorce petition at the Abu Dhabi Civil Family Court. The application can be filed in English or Arabic, and the court provides translation services as needed. Your attested and translated marriage certificate is required. 
  • No reconciliation process required 
    The applicant does not need to provide a reason for the divorce. Unlike previous systems, no mandatory mediation or reconciliation sessions are required, which expedites the process.
  • Notification and response  
    The court notifies the other spouse of the petition. While they may respond or contest related matters (e.g. custody, maintenance), they cannot stop the divorce from being granted.
  • Case Management Appointments & Divorce Judgment
    Once procedural requirements are met at case management appointments, the court issues a divorce judgment. This can typically be completed from start to finish within 30 days, depending on case complexity.

Related Matters Custody and Financial Settlements 

Although the divorce itself is granted on a no-fault basis, the court still assesses child custody, spousal maintenance, and asset division based on fairness and the best interests of the child. Custody is generally awarded jointly unless circumstances dictate otherwise.
