
UAE Introduces Landmark Family Law Reforms
As a family law specialist, I am pleased to see the UAE taking progressive steps to modernise its legal framework with the newly announced family law reforms, set to come into effect in April 2025.
These changes represent a pivotal moment in protecting the rights and well-being of families and children, aligning with the country’s forward-thinking vision for a modern society.
Key Changes to Custody and Child Welfare
One of the most transformative updates is the extension of child custody to age 18 for both boys and girls. This change reflects a stronger emphasis on the welfare of children and respects their growing independence. Notably, children aged 15 will now have the right to choose which parent they wish to live with, provided the court deems this decision to be in their best interests.
For non-Muslim mothers, the reforms also bring significant relief. Custody rights for children from Muslim fathers have been extended beyond the previous automatic transfer age of five. This inclusive amendment ensures that diverse family structures are given fair consideration, with final decisions made by the courts.
Expedited Dispute Resolution and Guardianship Adjustments
The new legislation also introduces measures to expedite family disputes, allowing educational guardianship issues to be resolved through the Urgent Matters Court. This approach reduces delays and ensures swift action when children’s education is at stake. Additionally, parents now have one year up from six months to file custody claims, with courts able to grant further extensions where valid.
Travel Rights and Financial Provisions
Travel provisions have been updated to allow either parent to travel alone with their child for up to 60 days annually, with extensions available in special circumstances. This adjustment supports co-parenting arrangements and reduces unnecessary legal barriers.
In terms of financial rights, wives can now claim up to six months of backdated maintenance and request increases to mandated amounts. Monthly alimony payments are prioritised over other debts, ensuring families receive the support they need promptly.

The law has introduced strict controls around the handling of children’s identification documents, with legal consequences for any misuse. These measures reinforce the UAE’s commitment to safeguarding children’s rights and ensuring the accountability of custodial parents.
